End-User License Agreement (EULA) of Sukar

We want you to know and understand your rights and our rights relating to the services. Make sure you review them carefully.

Terms of Service

The website of Sukar and the related mobile applications and services are made available to you by Sukar with its address at: Dubai, Jumeirah Village Triangle, District 0, Tulip Street, Villa M34

More information about our services may be on our website https://sukar.app/. You agree to comply with these "terms of service" and any supplemental terms which Sukar makes available to you on the services which shall form part of the "terms of service". This agreement is in English. To the extent of a translated version of the "terms of service" conflicts with the English version, the English version controls.

In case you use these services on behalf of a company or other entity, you represent that you have full authority to bind such entity and its affiliates to these "terms of service" and that it is entirely binding on them. In this case, the term "you" refers to the entity and its affiliates. In case you don't have the authority, you are not allowed to access or use the services provided by Sukar. The "terms of service" contain disclaimers of warranties and the limitations on liability that may apply to you.

Sukar cannot provide the service without processing the data about you and other Sukar members. Processing the data you share with Sukar is essential to the services which Sukar provides and a necessary part of our performance of the agreement we have with you.

Notice regarding dispute resolution:

These "terms of service" contain provisions that govern how disputes between you and Sukar are resolved. These include an agreement to arbitrate, which will, unless you are a resident of the European Union, with limited exception, require you to submit claims you have against Sukar to binding and final arbitration and limit you to claims against Sukar on an individual basis unless you opt-out following the instructions below.

Enrollment and User Accounts

The services provided by Sukar are intended for persons who have a minimum age of 13 years old or such higher age required in your country to use the services. When you are under the legal age to form a binding contract in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these terms of service on your behalf.

To use Sukar's services, you need to register. When you register you agree to:

  • Provide correct, accurate and complete information about yourself;
  • Maintain and promptly update the information about yourself.

When you register with Sukar, you agree that Sukar may use your personal information that you access or use and as otherwise outlined in these terms of service. Suppose you provide any personal information that is not correct or not current, or Sukar has a reasonable ground to suspect that such personal data is inaccurate or not current. In that case, Sukar has the right to suspend or terminate your account and refuse current or future use the services.

You are solely responsible for maintaining the confidentiality of the login associated with your account and for restricting access to your password and mobile device while logged into the Sukar services. You accept responsibility for all activities that occur under your account or from your mobile devices. We cannot guarantee the absolute security of your account, your content, or the personal data provided by you. We cannot promise that our security measures will prevent third-party hackers from illegally accessing the Services or its contents. You agree to immediately notify Sukar of any unauthorized use of your account or password or any other breach of security, and confirm that you understand all risks of unauthorized access to Member Data and any additional information or content you provided to Sukar.

You can register for or login to your Sukar account via a third-party network, such as Google or Apple. You with this authorize Sukar to pre-populate the registration and other relevant information fields of your account and to use such third-party credentials to log you into your account.

Payments and Service Charges

Payments

To pay any fee, you need to designate and provide information about your preferred payment method. When you submit your payment information, you authorize Sukar and specific third-party payment processors to receive, store and encrypt your payment information. If you paid through the Google Play or iTunes store, you might change your payment method through the corresponding store account. Sukar will not provide refunds or credits, other than as outlined in these terms of service. If your payment provider discovers that there are fraudulent charges on your account resulting from use of your payment method at the Sukar services, please contact us immediately via info@sukar.app.

Service Charges

To access premium functionalities of the Sukar service, you need to pay membership fees. Fees, together with additional required taxes, will be paid on a monthly or annual basis. All premium service fees are payable in advance. Members that will change from monthly to yearly premium memberships will have the annual rates take effect at the beginning of the next billing date. When you upgrade your premium membership, you will start a new billing date. You agree to pay the premium membership services charges, and other fees you incur in connection with your Sukar account, whether on a one-time or subscription basis. Sukar reserves the right to increase the services charges, any associated taxes, or to institute new fees at any time upon reasonable advanced notice.

Auto-Renewal

Premium membership charges will be billed automatically at the start of the billing period. These charges will auto-renew until you terminate your premium membership. Your premium membership charges will be the same as your initial charges unless we otherwise notify you in advance. You can terminate your premium membership at any time, as you can read below.

Cooling Off

When you are a resident of any country outside of the United States, you may be entitled to change your mind and receive a full refund within fourteen days. The cooling-off period only applies when you have not logged in or redeemed or started to use the services as a premium member during the cooling-off period.

Cancellation

When you signed up via Google Play or iTunes store, you can cancel your premium membership by downgrading through the corresponding store. The cancellation of your premium membership will go into effect at the end of your billing cycle. When you cancel your premium membership your account will still be active and become a free membership. You can renew your premium membership at any moment without opening a new account. Premium membership charges may have increased.

Member Content and Policy

Member Content

You are the owner of the information, data, text, software, sound, photographs, graphics, video, messages, posts, tags or other materials you make available in connection with the Sukar services.

You grant Sukar a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to: use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform and display any Content and any name, username or likeness that you post on or in connection with the Sukar services.
These apply to all media formats and channels now known or later developed without compensation to you. The license will end as soon as you delete your content on your account.

You understand that you and not Sukar are entirely responsible for all the content that you upload, post, email, transmit or otherwise make available via the Sukar services. Sukar does not proactively and routinely screen or monitor the material posted to the services by others. Therefore we don't guarantee the accuracy, integrity or quality of such content. Sukar may screen, monitor, refuse or remove any content that violates the terms of service or is otherwise unacceptable. You accept that using the Sukar services, and you may be exposed to content that is offensive, indecent or objectionable. Sukar will not be liable in any way for any content, or any loss or damage of any kind incurred as a result of the use of any content made available on the Sukar service. You do agree to bear all risks associated with the use of any content made available in connection with the Sukar services. These may include the reliance on the accuracy, completeness or usefulness of such content.

You do agree that Sukar is not in any way responsible for and does not endorse content posted on the Sukar services. If your content does violate these terms, you may bear legal responsibility for that content. As between you and Sukar, any material is non-confidential and non-proprietary and will not be liable for any use or disclosure of content. You do acknowledge and agree that your relationship with Sukar is not confidential, fiduciary or another type of special relationship. The decision to submit content does not place Sukar in a position which is different from the position held by other members of the general public, including the once about your content. Sukar will not be liable for any use or disclosure of any content you provided.

You permit Sukar to use your profile name and information about your activities and actions you have taken, including your use of third party products, services, devices, in ads, offers and other commercial contexts on the Sukar services without compensation to you.

Policy

We expect you to honour the SUkar standards. Sukar's services are for your personal use only. You are not allowed to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell for any commercial purpose any portion of the services. You are not allowed to use the services or assist or encourage any third-party, to engage in any of the following activities:

  • Copying or mirroring any part the Sukar services;
  • Accessing the Sukar service to monitor its availability, performance or functionality;
  • Allowing any third-party to access the Sukar services;
  • Using, copying, modifying, creating a derivative work of, reverse engineering, decompiling or otherwise attempting to extract source code of the software underlying the Sukar services.

  • Publishing, transmitting, distributing or storing content, material, information or data that:

    • is illegal, indecent, defamatory, threatening, harassing, abusive or hateful;
    • is harmful to or interferes with the Sukar services or any third parties networks, equipment, applications, services or websites.
    • infringes, dilutes, misappropriates or otherwise violates any privacy, intellectual property, publicity or other personal rights including, without limitation copyrights, patents, trademarks, trade secrets or additional proprietary information (including unauthorized use of domain names);
    • is fraudulent or contains false, deceptive or misleading statements, claims or representations;
  • Trying to disrupt, degrade, impair or violate the integrity or security of the Sukar services or the computers, accounts or networks of any third-party, including any activity that typically precedes attempts to breach security such as scanning, probing or other testing or vulnerability assessment activity, or engaging in or permitting any network or hosting an action that results in the blacklisting or other blockage of Sukar internet protocol space;
  • Avoiding payment of charges payable by you with respect to the Sukar services;
  • Performing to any act that may be harmful to minors;
  • Distributing, or disclosing parts of the Sukar services in any medium, including without limitation by any automated or non-automated scraping;
  • Making use of any automated system to access the Sukar services in a manner that sends more requests to Sukar than a human can reasonably produce in the same period;
  • Taking any action that imposes a significant load on our infrastructure; Using the Sukar services for any inappropriate commercial solicitation purpose;
  • Submitting to the Sukar services any information that may be protected from disclosure by applicable law;
  • Bypassing the measurements, we may use to prevent or restrict use or copying of any content or enforce limitations on use of the Sukar services or the content;

You understand that use of certain features of the Sukar services may require you to purchase third party equipment or materials. While Sukar can recommend the equipment or materials of individual suppliers, Sukar will have no responsibility for your acquisition or use of any third-party hardware or materials. Sukar does not guarantee that third-party equipment or materials will function with the Sukar services or will be free of errors.

You understand that you are responsible for any charges associated with sending communications via your device.

You at this moment, represent and warrant that:

  • You are authorized to create your account, individually or on behalf of an organization or entity;
  • You own the content posted by you on or via the Sukar services;
  • The posting and use of your content on or through the Sukar services does not and will not violate, misappropriate or infringe on the rights of any third-party;
  • You agree to pay for all royalties, fees and any other monies owed because of content you post on or through the Sukar services.

Third Parties

Products and services from third-parties on the Sukar service are made and offered by the applicable third party. When you decide to pursue or purchase such product or service, you agree that you are contracting directly with the third-party and now with Sukar.

Sukar or third-parties may provide links to other websites or resources through Sukar services. Sukar does not endorse and is not responsible or liable for any content, information, advertising, products or other materials on or available for such websites or resources.

Electronic Communications

The service may provide the ability to send or post messages via third-party service providers, advertisers, your contacts, and Sukar. You agree to use communication methods available on the Sukar service only to send communications and materials related to the subject matter. You agree that all such communications by you shall be deemed your content and shall be subject to and governed by the terms of service and applicable law. By using communication methods available on the Sukar service, you agree that:

  • All communications methods constitute public, and not private, means of communication between you and other party or parties;
  • All communications sent to or received from third-party, service providers are not endorsed, sponsored or approved by Sukar;
  • All communications are pre-reviewed, post-reviewed, screened, archived or otherwise monitored by Sukar in any manner. However, Sukar reserves the right to do so at any time.

You agree that all notices, disclosures and other communications that Sukar provides to you electronically shall satisfy any legal requirement that such communications be in writing.

Support and Questions

We will respond to any questions you have regarding the services and the "terms of service" via info@sukar.app. We generally respond to support requests within 48 hours after you submitted the support request.
